Form for informing the traveler in case of a package tour according to § 651a of the German Civil Code

The combination of travel services offered to you constitutes a package holiday within the meaning of Directive (EU) 2015/2302.

Therefore, you can avail yourself of all EU rights that apply to package holidays. Landhotel Spornitz van der Valk GmbH is fully responsible for the proper execution of the entire package holiday.

In addition, Landhotel Spornitz van der Valk GmbH has the legally required protection for the refund of your payments and, if transportation is included in the package tour, to ensure your repatriation in case of its insolvency.

Key rights under Directive (EU) 2015/2302

Travelers receive all essential information about the package tour before concluding the package travel contract.

At least one entrepreneur is always liable for the proper provision of all travel services included in the contract.

Travelers will receive an emergency telephone number or contact information for reaching the tour operator or travel agency.

Travelers can transfer the package tour to another person within a reasonable period and possibly at an additional cost.

The price of the package tour may only be increased if certain costs (such as fuel prices) increase and if this is expressly provided for in the contract, and in any case no later than 20 days before the start of the package tour. If the price increase exceeds 8% of the package tour price, the traveler can withdraw from the contract. If a tour operator reserves the right to increase prices, the traveler has the right to a price reduction if the corresponding costs decrease.

Travelers can withdraw from the contract without paying a cancellation fee and receive a full refund of all payments if one of the essential components of the package travel, except for the price, is significantly changed. If the entrepreneur responsible for the package travel cancels the package travel before the start of the package travel, travelers are entitled to a refund and possibly compensation.

Travelers can withdraw from the contract before the start of the package tour without paying a cancellation fee in the event of exceptional circumstances, for example if there are serious security issues at the destination that are likely to affect the package tour.

In addition, travelers can withdraw from the contract at any time before the start of the package tour by paying a reasonable and justifiable cancellation fee.

If essential components of the package travel are not carried out as agreed after the start of the package travel, the traveler must be offered appropriate alternative arrangements at no extra cost. The traveler may withdraw from the contract without paying a cancellation fee (in the Federal Republic of Germany, this right is called "termination") if services are not provided in accordance with the contract and this has significant effects on the provision of the contractual package travel services, and the tour operator fails to remedy the situation.

The traveler is entitled to a price reduction and/or compensation if the travel services are not provided or not provided properly.

The tour operator provides assistance to the traveler when they are in trouble.
In case of insolvency of Landhotel Spornitz van der Valk GmbH, payments will be refunded. If the insolvency of Landhotel Spornitz van der Valk GmbH occurs after the start of the package tour and transportation is part of the package tour, the return transportation of the travelers will be ensured. Landhotel Spornitz van der Valk GmbH has taken out insolvency protection with R+V Allgemeine Versicherung. Travelers can contact R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, +49 611 533-5859, if services are denied to them due to the insolvency of Landhotel Spornitz van der Valk GmbH.
